Can I get legal residency in the US with this VISA?

Yes, once all the legal requirements are fulfilled you and your spouse and unmarried, minor children can qualify and become to the United States of America as lawful permanent residents. This residency is temporal in the beginning, but it allows people to live and work in the United States. Two years later it becomes a permanent residency.

  1. How long does it take?

The first step in the process is to file an I-526 immigration petition, usually, the whole process time with USCIS takes 16-20 months,  for an EB-5 applicant to get a conditional green card for two years.  Preparing the file in our office takes between 30-45 days.

Second, I-829 Petition to remove the conditional green card. In this process, it has to be demonstrated that the project remained operational, and, demonstrate that the investment made, complied with the creation of the jobs indicated in I-526.
